Asmodee and Amazon file to take down Dixit tabletop game counterfeiters – ToyNews



Amazon and Asmodee Group have jointly filed a lawsuit against two defendants over producing counterfeit versions of the board game giant’s award-winning card game sets, Dixit: Daydreams Expansion and Dixit: Revelations Expansion.

The two Brooklyn, New York-based defendants attempted to offer the counterfeit products in Amazon’s store, a violation of Amazon’s policies and an infringement on Asmodee’s trademarks.

The lawsuit alleges that the two defendants – named as Crazy Leaf and Gig Trading Inc in posted court filings – used Asmodee’s registered trademarks without authorisation in order to deceive customers into believing the Dixit expansion sets were genuine.

Amazon received customer complaints that the counterfeit game Dixit: Daydreams being sold by the defendants in the Amazon store was inferior to the authentic product. In one instance, a customer complained that the counterfeit game cards they purchased had “horrible, DULL artwork. T[h]ese are nothing like the original cards. Certainly nothing to daydream about.”

Further examination of the counterfeit product determined that its features ‘departed significantly from the authentic product’ in three ways.

First, the images displayed on the counterfeit version lacked the vibrancy of the images displayed on the authentic version, indicating that the counterfeit images were reproduced from an unauthorized printer. Secondly, the formatting of the counterfeit version in terms of font and alignment differed from the authentic version. Third, in some instances, the color of the images displayed on the counterfeit version differed from the color of the images displayed on the authentic version.

Amazon has pointed out that it strictly prohibits infringing and counterfeit products in its store, and shut down the defendants’ selling accounts and refunded the impacted customers.

In 2020, Amazon invested more than $700 million and employed more than 10,000 people to proactively protect its store from fraud, counterfeit, and abuse. Last June, Amazon launched its Counterfeit Crimes Unit, a global team dedicated to pursuing counterfeiters and holding them accountable, including by working through the court system and in partnership with law enforcement. 

“The joint lawsuit with Amazon underlines how the protection of our brands is key for Asmodee,” said Céline Bucki, group legal director of Asmodee.

“We want to be sure that people will share the joy of playing with their families and friends, with high quality products, that respect creativity and innovation from our teams, and showcase our manufacturing and distribution partners’ quality standards.”

Founded in 1995, Asmodee is a leading games publisher and distributor with global blockbusters, including A Game of Thrones: The Board Game, Ticket to Ride, Spot It!/Dobble, Pandemic, and CATAN. Asmodee products are sold internationally, including through Amazon.com.

In July 2020, Asmodee acquired Libellud, which developed the award-winning storytelling game, Dixit. There are now 10 Dixit companion expansion sets, such as Daydreams and Revelations, which allow players to supplement their Dixit game with additional story cards.

The tenth Dixit expansion set recently launched, commemorating over a decade of success.
